A Lin woman from New Taipei City discovered a lump in her breast after giving birth ten years ago. Fearing she had breast cancer, she went to Linkou Chang Gung Memorial Hospital for further examination. Unexpectedly, the doctor directly removed her left breast during surgery, only to later discover that the lump was merely a benign tumor. After years of legal battles, the High Court ruled yesterday that the doctor and Chang Gung Hospital must compensate the woman NT$1 million for breast reconstruction costs.
This botched mastectomy left the Lin woman hiding indoors for nearly a decade, afraid of facing judgmental stares due to her physical imperfection. What angered her most at the time was that the doctor who wrongly removed her breast never once apologized.
Ten years ago, shortly after giving birth, Lin noticed a lump in her breast. After an initial examination at En Chu Kong Hospital, she sought treatment from Dr. Yeh Chun-nan at Linkou Chang Gung. Without performing a biopsy to confirm the diagnosis, the doctor proceeded with surgery to remove her left breast, only to later find out it was just a benign tumor.
The High Court has now ruled that Linkou Chang Gung and the doctor must compensate Lin NT$200,000 for breast reconstruction and NT$800,000 for emotional distress, totaling NT$1 million. In a separate criminal case, Dr. Yeh was sentenced to three months in prison last year, convertible to a fine, with the verdict final.
